Ambrstack provides a comprehensive data orchestration suite designed for Solutions Partners and organizations managing complex data systems. Our platform includes:

2.1 CONFIGURE

A digital experience platform that provides one-click onboarding and setup for CRMs, project management tools, HRMS, and other business systems. CONFIGURE enables rapid platform implementation with automated configuration and data structuring.

2.2 SWITCHER

A secure data migration platform that facilitates seamless data transfers to and from any platform. SWITCHER provides comprehensive data mapping, transformation, and validation capabilities to ensure data integrity during migrations.

2.3 Additional Features

• Complete visibility into data structures, mappings, and transformations
• Unified workflows for implementations, migrations, and data operations
• Automation capabilities for data orchestration tasks
• System-agnostic flexibility across multiple platforms
• Governance and control tools for complex data environments

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must immediately notify Ambrstack of any unauthorized use of your account
• Ambrstack is not liable for any loss or damage arising from your failure to protect your account credentials

You retain all ownership rights to the data you submit, upload, or process through the Services. By using our Services, you grant Ambrstack a limited license to process your data solely for the purpose of providing the Services to you.

• Ambrstack does not permanently store customer data on our servers

While we strive to provide continuous access to our Services, we do not guarantee uninterrupted availability. The Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Ambrstack reserves the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

11.2 Termination by Ambrstack

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice, for any reason including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Non-payment of fees
• At our sole discretion to protect our Services or other users

11.3 Effect of Termination

Upon termination, your right to access and use the Services immediately ceases. We may delete your account and data in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination will continue to apply.

12. Disclaimers and Limitations of Liability

12.1 Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AMBRSTACK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Ambrstack does not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMBRSTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF AMBRSTACK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL AMBRSTACK'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU TO AMBRSTACK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Ambrstack, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Any data you submit, upload, or process through the Services

14. Dispute Resolution

14.1 Informal Resolution

Before filing a formal claim, you agree to contact us at talk@ambrstack.com and attempt to resolve the dispute informally.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ambrstack operates, without regard to its conflict of law provisions.

14.3 Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of the applicable jurisdiction, and you hereby consent to personal jurisdiction and venue therein.

15. Changes to These Terms

Ambrstack reserves the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending a notification to the email address associated with your account
• Displaying a notice within the Services

Ambrstack shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, war, terrorism, pandemics, natural disasters, or failures of third-party services.
